1. Scope

These Terms & Conditions apply to all orders placed by consumers through the online shop at www.happypastimes.com with Malte Klingbeil (hereafter "I" / "me").

3. Formation of Contract

The presentation of products on this website does not constitute a legally binding offer on my part, but rather a non-binding invitation for you to place an order (invitatio ad offerendum).

The ordering process runs through the payment provider Stripe: clicking "Buy Now" redirects you to Stripe's payment page. Completing payment there constitutes a binding offer to purchase the ordered goods. The purchase contract is concluded once I accept that order — either by sending an order/payment confirmation by email, or by actual delivery of the goods, whichever happens first.

4. Prices, Delivery Area & Shipping Costs

All stated prices are final prices. In accordance with § 19 UStG (German small business regulation), I do not separately state VAT.

I currently ship exclusively within Germany. Shipping is free; shipping costs are already included in the stated price. No additional shipping costs apply unless you explicitly choose a delivery method other than the standard delivery I offer. Shipping to additional countries is planned for the future.

5. Payment

Payment is processed exclusively via the payment provider Stripe, using whichever payment methods Stripe offers at the time of your order (e.g. credit card). Stripe's own terms of use apply in addition.

6. Delivery

Shipping is via Deutsche Post within 3–18 business days of payment. Delivery within Germany usually takes a further 1–3 business days after that.

For limited or special print runs, I reserve the right to cancel an order and refund the full purchase price if the ordered item is no longer available after payment is received.

7. Retention of Title

Delivered goods remain my property until paid in full. Since payment in this shop always occurs before the goods are shipped, this clause has no practical relevance in the ordinary course of business.

8. Warranty

Statutory warranty rights for defects apply. If you receive a defective or damaged item, please get in touch by email at malte@happypastimes.com.

9. Right of Withdrawal

As a consumer, you have a statutory right of withdrawal. Details can be found in the separate Right of Withdrawal Policy.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), available at ec.europa.eu/consumers/odr. I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Governing Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in another EU member state, mandatory consumer-protection provisions of that state remain unaffected by this choice of law.

12. Final Provisions

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
